I admit it, this case is one I’m strangely fascinated by.
“On Tuesday morning, the nine justices of the Supreme Court put a legal theory from Microsoft to the test—that the company should not be forced to hand over data held abroad to the American government, even when served with a valid court order.”
The reasons for my fascination are laid out in the oral arguments that were reported in the article. On one hand, should a US based cloud provider simply be allowed to store data elsewhere and never turn it over to US Law Enforcement? Or, should the US be allowed to order a company to go grab data held outside the US, thus opening up the possibility of other countries doing the same with data held in the US?
I don’t really know which is worse. What do you think?
